Affidavit of Intent to Circulate a Recall Petition

City of McKinney, Texas

County of Collin §

Each of the undersigned five (5) voters of the City of McKinney (the “Petitioners’ Committee,” being the five voters authorized by Charter Sec. 144), being duly sworn under the individual jurat accompanying that affiant’s execution of this affidavit below, deposes and states as follows:

1. Each affiant is a registered voter of the City of McKinney, Texas, residing at the address shown beside their name below. The five affiants constitute the committee of the petitioners whose names and addresses shall appear on each petition paper (Charter Sec. 134) and shall be regarded as responsible for the circulation and filing of the petition.

2. Pursuant to Charter Sec. 144, the affiants make and file this affidavit seeking the removal of the following officers of the City of McKinney, whose names and offices are (Sec. 144 permitting one affidavit to contain “the name or names of the officers whose removal is sought”):

  1. Bill Cox, Mayor;
  2. Ernest Lynch, Council Member At-Large 1;
  3. Geré Feltus, Council Member, District 3; and
  4. Justin Beller, Council Member, District 1.

3. Pursuant to Charter §144, the affiants request a sufficient number of numbered, dated petition blanks bearing the City Secretary’s signature and listing together all officers named in Paragraph 2, and that their issuance be recorded. The affiants acknowledge that under §145 the completed petition must be filed within forty-five (45) days after the filing of this affidavit, and that no petition paper is valid unless issued bearing the City Secretary’s signature.

4. The grounds upon which removal is sought are as follows (the “Statement of Grounds”):

“A loss of public confidence in the ability of the officers named herein to faithfully represent the citizens of the City of McKinney”

5. The Petitioners’ Committee will be responsible for circulating the petition and filing it in proper form with the City Secretary within the time required by the Charter.

6. The filed page designates John Aselton to receive notices to the Petitioners’ Committee. His residential address and personal email are visible in the source scan but are not duplicated in this machine-readable transcript.

Execution by the Five Affiants

Each affiant executes this affidavit before a notary public under the individual jurat set forth with that affiant’s execution below. The five executions together constitute the single affidavit of five (5) voters required by Charter §144.
